Event Booking Terms and Conditions

These booking conditions together with the other information contained on this websites – www.ibizarocks.com and events.ibizarocks.com  form the basis of your contract with IBIZA ROCKS HOTEL PROMOCIONES S.L. Please read them carefully as they set out our respective rights and obligations.

1. INTRODUCTION

1.1 In these conditions a reference to:

  1. “You”, “Your” means the person making the booking and other attendees related to your ticket/bed purchase
  2. “Lead Name” means the person identified as making the ticket/bed purchase during the booking process”
  3. “Hotel” means, as the context requires, the hotel in which a particular Event Venue situated;
  4. “Venue” means the location of the event; which would be inside Ibiza Rocks Hotel 
  5. We”, “Us”, “Our” mean IBIZA ROCKS HOTEL PROMOCIONES S.L. a company registered in Spain with registration number B57615809 and registered address at Travesia del Mar 7 Bajos 07820 San Antonio, Baleares, Spain;
  6. IBIZA ROCKS HOTEL PROMOCIONES S.L. is covered by an INDIVIDUAL DEPOSIT sum to the limit of 60,000 euros, to guarantee the economic responsibilities in case the obligations are not met before the consumers and end-users – Art 10 of Decree 13/2011, on 25 February – , which it is established that the general provisions necessary to have the freedom of establishment and provision of touristic services, the regulation of the declaration responsible and simplification of the administrative procedures related to tourism.

1.2 Please read the Terms and Conditions carefully. They apply to all bookings made for IBIZA ROCKS HOTEL PROMOCIONES S.L. and to all members of your event booking..

2. EVENT DATES, TIMINGS & PROGRAMME

  1. All IBIZA ROCKS HOTEL PROMOCIONES S.L. events, as well as other branded events by external promoters will take place in the Ibiza Rocks Hotel on selected dates in April, May, June, July, August and September. All event programmes, days and dates are subject to change. Any specific artists or event programmes presented at time of booking are not guaranteed to be the eventual artist or event programme.
  2. You should always check that your booked Event is going ahead at the scheduled date, time and venue.
  3. Headline artist set times for events are not announced in advance and are subject to change. Our advice is to always ensure you arrive at the venue before 16:00 to ensure that you do not miss any of the headline acts.  Last entry is 20:00 for daytime events and 22:00 for evening events.
  4. Your Event Booking will remain confirmed regardless of the weather on the event day unless otherwise communicated by the official communication channels of IBIZA ROCKS HOTEL PROMOCIONES S.L


3. ENTRANCE POLICY & CONDUCT

  1. No one under the age of 18 will be permitted to enter the Venue. Any customer who is under-age at the time of the event will not be allowed into the Venue and no refund will be issued.
  2. Every person entering the Venue must have a valid form of photographic identification, such as a passport or driver’s license.
  3. The management reserves the right to deny admission, to refuse any entry and/or eject any person from the Venue who appears to be intoxicated, under the influence of drugs, or behaving in a dangerous, inappropriate or abusive manner. Please note that no refunds will be given in these circumstances.
  4. Any form of verbal or physical abuse towards employees of Ibiza Rocks Hotel or fellow customers will not be tolerated and may result in prosecution.
  5. For safety reasons, we reserve the right to search clothing, bags, and all other items upon entry and exit, and we may confiscate any items that may cause danger or disruption to others.
  6. Food and drink items purchased outside the Venue are not allowed to be taken inside the Venue. This also applies to guests of the Ibiza Rocks Hotel.
  7. Entry into the Venue is at the manager’s discretion, and anyone who does not comply with local regulations concerning public bathing or swimming will be asked to leave the premises.
  8. There will often also be rules restricting or preventing the admission of latecomers depending on the time of arrival and the time the event finishes.  Please note the last entry times of the venue and conditions of Your purchased Event option.
  9. SLR cameras, unauthorised video cameras or  equipment for the professional recording or transmitting (by digital or other means) of any audio, visual or audio-visual material within the Venue is strictly forbidden and is not permitted at any time. Any such material may be confiscated and/or destroyed by the Promoter. Any recording made of the Event in breach of the Conditions shall belong to the Promoter and You agree to assign any and all rights in any such recordings to the Promoter. If you wish to record inside the venue, please contact our marketing team in advance. Selfie sticks are also not permitted.
  10. You shall not bring into the Venue or display or distribute at the Event any sponsorship, promotional or marketing materials without the Venues prior written consent.
  11. By entering the Event You give Your express consent to being photographed/filmed or sound recorded as part of the audience, and to Your name, voice and/or likeness being included within any film, photograph, audio or audiovisual recording of the Event to be exploited in any and all media for any purpose at any time throughout the world with no reimbursement or copyright. This may include filming by the police or security staff for the security of attendees at the Event or the prevention of crime.
  12. Animals are not allowed in the venue.
  13. We have a strict no re-entry policy.
  14. Disabled facilities are available. Please contact Us in advance of the Event at events@ibizarocks.com if You have any specific access requirements, otherwise it may not be possible to meet Your needs.
  15. If You or any member of your party has any other particular requirements please raise these when booking and we will endeavour to address your query (Contact us: events@ibizarocks.com). There can be no guarantee that requirements can be met if notified at the event.


4. TICKET TERMS & CONDITIONS

  1. Full payment (including any booking/processing fees) will be required for your event tickets at time of booking
  2. Your Ticket will be dispatched to you electronically and to the email address provided at the point of booking.  Always check Your Ticket email upon receipt and advise us promptly of any errors. Mistakes when ordering cannot always be corrected, and any corrections are discretionary.
  3. The ticket is only valid for the specific date purchased and must be shown on entry into the Venue alongside photographic ID that matches the named ‘Lead Guest’ marked on the ticket email.
  4. It is Your responsibility to check and understand any additional entry conditions of Your Ticket. Failure to comply with these conditions will result in your entry becoming void. If you purchase a ticket marked “Early Entry” you must enter the venue before the time displayed on Your Ticket / Booking Confirmation. If you arrive at the venue after this stated time you may be required to pay an additional fee to enter.
  5. Please note that the ticket price on the Ibiza Rocks website is the advance ticket price and can only be purchased until 10am on the day of the event. Entrance paid at the door on the day may be higher than the advance price.
  6. Should you need to make any amendments to your ticket at any time prior to the event itself, please email us at events@ibizarocks.com and we will review your request in-line with the terms and conditions.
  7. Should you wish to cancel your Ticket completely at any time this will result in a loss of 100% of total booking amount (including any booking/processing/cover charge fees).
  8. Tickets are sold subject to the management’s right to alter or vary the events calendar due to events or circumstances beyond its control without being obliged to refund money or exchange tickets.
  9. The purchaser represents and warrants that the ticket is purchased for personal use only, and may not be resold or offered for resale by anyone.
  10. Resale or attempted resale of a ticket is grounds for cancellation of that ticket, and the holder may be refused entry to or ejected from the Venue without refund or other compensation.
  11. If an event is rescheduled, ticket holders will be offered tickets to the rescheduled event.
  12. Clients who have purchased General Admission Tickets must arrive before 7pm. We cannot guarantee General Admission Entry after this time.
  13. Tickets cannot be used as part of any marketing, media, sales promotion or competition, whether commercial or non-commercial, or be combined with any hospitality, travel, accommodation service to create a Ticket package without the prior written consent of the venue.


5. VIP RESERVATION (BEDS / SOFAS / TABLES) 

  1. All VIP reservations at the Venue are based on a cover charge plus a minimum spend agreement unless clearly stated. The cover charge is the hire cost of the bed/table/sofa space, which includes entry to the venue. The minimum spend is the minimum amount your party commits to spend that day on food and drink from the venue.
  2. At time of booking either 100% (full payment) or 20% (deposit) of the minimum spend plus 100% of the cover charge (plus any booking/processing fees) is required. These amounts may vary per event or per event option.
  3. If choosing to pay a deposit the remaining 80% balance of the minimum spend must be paid no later than 7 days prior to the booked event date – 14 days prior to the event a payment link will be sent to the email address of the lead booker. 
  4. If you are making a VIP Reservation within 14 days of the event, 100% payment is required at time of booking
  5. Should you wish to cancel your VIP Reservation – up to 14 days before the booked event this will result in a loss of deposit amount (including any cover charge & fees paid). Cancelling within 14 days will result in a loss of 100% of total booking amount (including any booking/processing fees)
  6. Your minimum spend can only be spent against Table Service orders only from the VIP menu and cannot be used at any Venue Bar unless stated. Payment for Food or Drinks purchased from the Venue bar would need to be settled separately. 
  7. If you do not reach your minimum spend during the hours of the event, you will not be refunded the difference, and the remaining amount cannot be transferred to another booking or event. If you spend over your minimum spend amount the balance difference will need to be settled before you leave the Venue.
  8. Bed / Sofa / Table spaces are allocated based on the category/area you have booked and the size of your group. The Venue has the right, at its discretion to move/upgrade customers to a different location and piece of furniture within the Venue at any point. In these instances, and given the switch will always be to a similar or better piece of furniture, You will not be entitled to any form compensation. Any such change will be discussed with You at the venue.
  9. No extra guests will be allowed to join the reservation beyond the stated capacity of the space(s) you have purchased. This includes guests with Tickets.
  10. Your VIP reservation Ticket will be dispatched to you electronically and to the email address provided at the point of booking.  Always check Your Ticket email upon receipt and advise us promptly of any errors. Mistakes when ordering cannot always be corrected, and any corrections are discretionary.

  15. Bed / Sofa / Table spaces are sold subject to the management’s right to alter or vary the events calendar due to events or circumstances beyond its control without being obliged to refund money or exchange tickets.
  16. The purchaser represents and warrants that the Bed / Sofa / Table space is purchased for personal use only, and may not be resold or offered for resale by anyone.
  17. Resale or attempted resale of a Bed / Sofa Table space is grounds for cancellation of that ticket, and the holder may be refused entry to or ejected from the Venue without refund or other compensation.
  18. If an event is rescheduled, VIP reservation holders will be offered tickets to the rescheduled event.
  19. Please be aware of your belongings during your time in the Venue we cannot be held responsible for any unattended alcohol or personal items.
  20. Clients who have made a VIP reservation must arrive before 6pm. We cannot guarantee entry after this time and your Bed / Sofa / Table space may be resold without being obliged to refund any monies paid.
  21. Any Bed/Sofa/Table options cannot be used as part of any marketing, media, sales promotion or competition, whether commercial or non-commercial, or be combined with any hospitality, travel, accommodation service to create a Ticket package without the prior written consent of the venue.


6. HOTEL GUESTS

  1. Guests staying at the Ibiza Rocks Hotel have General Admission Tickets to all events occurring in the Venue during the dates of their stay included in the price of their room. This is true of all guests regardless of booking provider (unless stated)
  2. Guests staying at the Ibiza Rocks Hotel who book a VIP bed, sofa or table for any pool party during their stay (either online on events.ibizarocks.com or at the Venue) will receive the full value of their Cover Charge fee added to their minimum spend.


7. PRICING & PURCHASES

  1. All prices are displayed in the local currency to the event location (in this instance euros/€).  Should prices be displayed in any other currency they are indicative only.  Any price presented when selecting any currency other than the local currency is based on an indicative exchange rate. Upon checkout, depending on your payment method and card supplier, you may be given the option to pay in another currency. If you choose to pay in a different currency the final price charged to your account will depend on both the rate of any commissions applied by the card payment provider together with the effect of any differential in the exchange rate applied by your own bank/card provider compared to our indicative rates (at the time of your bank processing the transaction).
  2. All purchases are subject to credit or debit card verification (if applicable), other security checks, and collection of payment by us. Your order may be cancelled if it has not passed our verification process or if payment is not received in full. In rare circumstances, if your payment is recalled by the associated bank or payment provider, we reserve the right to cancel and refund any order for which an order confirmation has been sent. We accept no responsibility or liability for such cancellations, as these are outside our control.
  3. To prevent fraud and protect us, we reserve the right to carry out checks and/or request that additional information be provided in order to verify purchases. We reserve the right to cancel any orders that we reasonably suspect to have been made fraudulently, without any notice to you, and any and all Items obtained as part of such orders will be void.
  4. Whilst we try to ensure that all advertised prices are accurate, errors may occur. If we discover an error in the price of any Item you have ordered, we will inform you as soon as possible and give you the option of confirming your order at the correct price (in which case we will credit or debit you as applicable) or cancelling your order (in which case you will receive a full refund). If we are unable to contact you to confirm your order at the correct price, you agree that we may treat the order as cancelled and issue you with a full refund, without any further liability.
  5. Sale Prices may increase or decrease at any time, based on demand. This is similar to how airline tickets and hotel rooms are sold and is commonly referred to as “Dynamic Pricing”. You will not be entitled to a refund or credit if (i) the Sale Price you paid for a Ticket was at any time before you purchased your Ticket less than the Sale Price you paid; or (ii) the Sale Price of any other Tickets to the relevant event (whether in the same price category or otherwise) is/are subsequently reduced after you purchase your Ticket.
  6. Payments may be made by any major credit or debit card. We use sophisticated encryption technology to ensure your credit card details are secure. We do not accept laser cards or cash cards.
  7. Your contract for purchase starts once we have confirmed your booking (which is immediate from your payment being processed upon check-out) and ends immediately after completion of the event for which you have purchased Item(s).
  8. All online orders are subject to a Processing Fee of at least €5. This is inclusive of a €2 donation to the Venue partner charities.
  9. Your payment will be fully invoiced by IBIZA ROCKS HOTEL PROMOCIONES S.L. a company registered in Spain with registration number B57615809 and registered address at Calle Cervantes 07820 San Antonio, Baleares, Spain.


8. RESCHEDULED & CANCELLED EVENTS

  1. If an Event is rescheduled, the Venue will usually give you the option of either retaining or exchanging your ticket for a new date, or alternatively claiming a refund.
  2. If an Event is fully cancelled by the venue, you will be offered a full refund of the monies paid to date via email. 
  3. Any rescheduling or cancellation will be communicated to you by means of an email to the email address provided at the time of booking. To claim any refund (should one be offered) you must take action by following the instructions provided within communications from the Venue/Promoter.  If we do not hear back from you within 30 days of the Event being cancelled & communicated to You we will automatically cancel your booking with no refund.
  4. Any refund agreed will be; Paid to the same payment method used to pay for the ticket (or any payment method mutually agreed between yourself & the venue) & paid within 7 – 60 days of the date a refund was agreed between yourself and the Venue
  5. No refunds will be offered under any circumstances if you fail to comply with all terms and conditions applicable to the ticket, the venue and/or the event.
  6. Any Booking and/or transaction/processing fees are non-refundable in any circumstances.


9. DRESS CODE

  1. The Venue reserves the right to refuse admission for unsuitable attire, which includes body paint, fancy dress, novelty shoes, and hen/stag accessories (including veils, sashes, and matching t-shirts). Props, including inflatables, are strictly prohibited.
  2. All guests must wear footwear to arrive and are also required to depart the venue respectfully clothed (tops and shorts/skirt).
  3. To bathe in the pool, proper bathing attire is required.
  4. You may not enter the pool fully clothed.
  5. Please note that topless bathing is not permitted in the venue.

10. PERSONAL BELONGINGS

  1. We do not store any luggage or large bags at the venue, so they will not be permitted inside.
  2. Please note that all customers are responsible for their own belongings when attending an event. The Venue does not accept any responsibility for any personal property. We do have lockers for small items, so please speak to our team if you want to use these facilities.
  3. The Venue does not accept any responsibility for the loss or damage to any property deposited in its lockers, phone charging units, or bed safes.
  4. We will not accept any liability for the loss of jewellery, other valuables, or money contained within a deposited item. We ask that all customers report immediately to the Manager any missing items that have been deposited in the lockers or bed safes.
  5. To help us provide the best customer service, please report any lost property as soon as possible, and we will do our best to reunite you with your items.
  6. Any personal possessions or other items which are found at the Event shall be retained by the Venue for a period of 30 days following their discovery.  During this period You may collect any item which belongs to You from a location specified by the Venue upon reasonable proof of identification and ownership.  If, upon the expiry of 30 days from the date of its discovery, any item has not been collected by You, the Venue reserves the right to dispose of any such items as it sees fit without any further liability to You (notwithstanding anything else in the Conditions).  Where possible, any uncollected items will be donated to charity.


11. SAFETY & WELL BEING

  1. In case of injury or accident, please make yourself known to our team. 
  2. Please act and drink responsibly inside the venue, and make sure you stay hydrated, especially during peak season when the sun is strongest.
  3. Please remember the following when receiving bottles of champagne and opening them. Do not shake or point the bottle in the direction of yourself or anyone else.
  4. When the bottle is empty, please dispose of the glass bottle safely or give it to a member of the team.
  5. Please be aware that the Venue Pools are shallow pools with a maximum depth of only 0.75M. Please take care, only enter this pool by using the steps and DO NOT jump or dive into the pool under any circumstance
  6. If coming from abroad It is a strict requirement of Ibiza Rocks Hotel Promociones for you to have adequate and comprehensive Holiday/Travel Insurance to attend an event at the Venue


12. COMPLAINTS

  1. If you have a complaint whilst you are attending an event, you must inform the Customer Service Team, Venue Management, Concierge or Reception at the Venue immediately in order to give them the chance to resolve the problem. A report form should be completed with a member of the Venue team whilst you are at the event. Any right to compensation may be lost if you fail to do this. If you are not offered a report form please ask to speak with a member of the Management team at the Venue.
  2. If you made a booking through an agent or third parties please direct any post event complaints to the booking agent (such as Jet2, On The Beach, Booking.com etc.) in the first instance, they will make contact with the Venue Provider on your behalf to get a resolution. You must still report the issue to the Customer Service Team or Reception Team in resort during your stay.


13. OTHER

  1. Maintenance, changes and improvements take place all season round. No compensation will be offered if a facility is unavailable during your event, but the Venue will endeavour to provide a suitable alternative.
  2. We cannot be held responsible for the failure of public services (e.g. water, gas, electricity etc.) or for any disturbance that is beyond our control. In all cases including personal injury or death, our liability to you for the total of all claims arising out of your holiday with us, is limited to the cost of the booking.
  3. “Force Majeure” means any cause beyond the Venue / Promoter’s control including, without limitation, act of God, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, national mourning, theft of essential equipment, malicious damage, strike, lock out, weather, third party injunction, national defence requirements, acts or regulations of national or local governments.  The Venue will not be liable to You for failure to perform any obligation under the Conditions to the extent that the failure is caused by Force Majeure.
  4. We cannot be liable in any way for the acts or omissions of others.
  5. The purchase by you of accommodation and/or event passes/events daybeds, tables or sofas and these terms and conditions (and any contractual or non-contractual matters arising in relation to these terms and conditions) are governed by Spanish law and any disputes arising out of any transaction between you and IBIZA ROCKS HOTEL PROMOCIONES are subject to the exclusive jurisdiction of the Spanish Courts.
